Sure, many of those who are arrested are also found guilty of DWI, but a large number of innocent people are also arrested for suspicion of DWI. That is the biggest cause of concern for every one of us.

First and foremost, you need to understand that refusing to answer the questions of a police officer is not a crime. Answering the question is a voluntary act and the Fifth Amendment to the U.S. constitution guarantees you the “right of silence”. However, walking away from the spot is also not a solution. The best way is to request the officer that you are in a hurry and want to leave at the moment. Then, if the need be, you must consult your attorney in this regard.

In some states and counties, loitering on the road without a reason is considered a crime and a cop possesses the right to detain you, in this case.
